Code of Practice for Planning Consultations

The Broads Authority is committed to enabling and encouraging involvement in its decision making process.

We are particularly keen to involve communities in the planning process by seeking views on planning applications and other forms of development proposals.  As part this we undertake consultations so that residents who live and work within the area have a say, and to ensure their views have been taken into account.

Aims and objectives

We will:

  • Undertake consultation as a fundamental part of the planning service
  • Value the time and energy people put into responding to consultations, and make it simple for you to inform us what you  think
  • Make available details of planning applications for inspection on the authority’s website
  • Encourage you to submit your comments online
  • Communicate clearly the purpose of any consultation and when a decision will be taken
  • Provide enough information about the development proposal in order to assist you in making an informed contribution
  • Use plain English
  • Publish details of the decision at the end of the process.

Consultation

It is a statutory requirement that planning applications are publicised in the locality to which they relate. The form publicity can take varies according to the type of application and the location but the statutory requirements are quite limited.

We will:

  • Publicise planning applications and other submissions widely, well in excess of the statutory requirements
  • Allow 21 days from the date of the site notice or neighbour notification letter for responses to be made
  • Allow 14 days from the date of the press advertisement for responses to be made
  • Endeavour to carry out consultation for planning applications in the following ways:

If the nature of development is:

  • A proposal accompanied by an environmental statement
  • A proposal which is contrary to the Broads Development Plan
  • Proposals affecting a public right of way
  • Major development, including development likely to be of interest to a wider number of people
  • Telecommunications development.

Publicity/consultation will be undertaken by:

  • Advertising the proposal in a newspaper circulating in the locality
  • Sending details of the application to the respective district/borough/city council via a weekly list of validated applications
  • Displaying a notice of the proposal on or near the site
  • Consulting immediate neighbours about the proposal by letter or email
  • Consulting by letter or email the respective parish council and respective district/borough/city council ward member/s
  • Publishing details of the application on the Authority’s website
  • Consulting any relevant statutory and non-statutory bodies.

If the nature of development is:

  • Minor development including single dwellings, householder extensions, changes of use and advertisements.

Publicity/consultation will be undertaken by:

  • Sending details of the application to the respective district/borough/city council via a weekly list of validated applications
  • Displaying a notice of the proposal on or near the site
  • Consulting immediate neighbours about the proposal by letter or email
  • Consulting by letter or email the respective parish council and respective district/borough/city council ward member/s
  • Publishing details of the application on the Authority’s website
  • Consulting any relevant statutory and non-statutory bodies.

If the nature of development is:

  • Development and other proposals affecting the setting of a listed building, character or appearance of a conservation area.

Publicity/consultation will be undertaken by:

  • Advertising the proposal in a newspaper circulating in the locality
  • Sending details of the application to the respective district/borough/city Council via a weekly list of validated applications
  • Displaying a notice of the proposal on or near the site
  • Consulting immediate neighbours about the proposal by letter or email
  • Consulting by letter or email the respective parish council and respective district/borough/city council ward member/s
  • Publishing details of the application on the Authority’s website
  • Consulting any relevant statutory and non-statutory bodies.
