Examination of the Local Plan for the Broads 2018

Full Authority, on 16 March 2018, resolved to submit the Local Plan for the Broads to the Planning Inspectorate for examination in public.

The Local Plan was sent to the Planning Inspectorate on 19 March 2018. All examination documents are in the Examination Library (see below).

Inspector's Report

We have now received the Inspector’s Report. This concludes that subject to modifications, the Local Plan is sound.

The Local Plan will now go to Planning Committee and Full Authority in May for adoption.

Consultation of modifications to the Local Plan

Following the close of public hearings in September 2018 the Inspector has written to the council advising what modifications are likely to be required in order for the plan to be found ‘sound’. 

A consultation on these modifications ran from 28 January to 15 March 2019.

This consultation was not an opportunity to re-state previous representations, as these have already been considered as part of the examination. This was also not an opportunity to raise new objections to the submitted Local Plan. This consultation was purely on the modifications and it is only these which are available for comment. Responses to this consultation were considered by the Inspector before she prepared her final report on the Local Plan for the Broads.

Sustainability Appraisal

The Modifications Consultation Sustainability Appraisal Report was also available to comment on. The changes to the report reflect the changes to the Local Plan and are marked up in a similar way to the Local Plan.

Habitat Regulations Assessment

The Habitat Regulations Assessment was republished in full to take into account the proposed Main Modifications and is subject to consultation alongside the Main Modifications.

Additional Modifications

Alongside the consultation on Main Modifications, the Authority has also published a number of proposed ‘Additional Modifications’ which it wishes to make to the plan prior to adoption. These ‘Additional Modifications’ do not materially alter the policies of the plan and are generally minor clarifications, consequential amendments associated with the Main Modifications and corrections of factual errors in the supporting text of the plan.

Policies Maps modifications

A number of changes were proposed to the Policies Maps to take into account ‘Main Modifications’ and ‘Additional Modifications’ and to correct other errors noticed since publication. A schedule of policies map changes was published together with revised policies maps incorporating the proposed changes.

Planning Inspector

The Planning Inspector was Ms Katie Child BSc (Hons) MA MRTPI. Her task was to examine the soundness of the Plan and whether it met the requirements of the Planning and Compulsory Purchase Act 2004 and associated regulations.

Programme Officer

The Programme Officer for the Examination was Lottie Carlton (who took over from Maria Conti). In this capacity she acted as an independent link between all parties and the Planning Inspector, and was the first point of contact on all Examination matters.
